The agreement between you and Hers For The Taking.
These Terms of Service ("Terms") are an agreement between you and Hers For The Taking ("we," "us"). They govern your use of hersforthetaking.com (the "site") and the digital and physical products, programs, emails, and downloads we sell or provide (the "products").
By using the site or buying a product, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the site or buy our products.
You must be at least 18 years old to buy from us or use the products. By purchasing, you confirm that you are.
Our programs are delivered as a mix of scheduled emails and mobile web pages, with optional downloadable files. Access is tied to the email address you buy with. Physical products are shipped per our Shipping Policy. We may improve, change, or retire products over time; if we materially change a product you already bought in a way that reduces what you paid for, we will work with you to make it right.
Prices are shown on the site and may change, but changes do not affect purchases you have already made. Payment is handled by our third-party payment processor; we do not store full card numbers. You agree to provide accurate purchase information.
Refunds are governed by our Refund and Satisfaction Policy, which is part of these Terms.
When you buy a product, we give you a personal, non-exclusive, non-transferable license to use it for your own personal and professional development. You may print or save materials for your own use. You may not resell, redistribute, share access to, publicly post, or use our content to build a competing product, and you may not remove our branding. The license lasts as long as we offer the product and your access remains in good standing.
The products, the site, and all content in them (text, scripts, designs, logos, the "Hers For The Taking" name, and the program materials) are owned by us or our licensors and are protected by intellectual-property laws. Buying a product gives you the license above, not ownership.
When you reply to our program emails, leave a review, send feedback, or otherwise communicate with us, you give us useful information about how the products work in real life. By buying from us or using the site, you agree that we may use that information, along with information about how you use our products, to run and improve our business. That includes improving our products, understanding our customers, informing our business decisions, and marketing our work.
We handle this responsibly:
If you give us feedback or suggestions, you agree we may use them to improve our products and business with no obligation to you.
Do not use the site or products to break the law, infringe anyone's rights, share your access with people who have not paid, scrape or copy the content at scale, or interfere with how the site works.
Our programs give you tools, scripts, and a method for making your work more visible and building your case at work. They describe what you can do; they cannot promise a specific result. We do not guarantee a promotion, a raise, a title, a particular income, or any other specific career or financial outcome. Nothing in our content is professional, legal, financial, or medical advice or a substitute for it. What you get out of a program depends on your situation and the actions you take.
The site and products are provided "as is" and "as available," without warranties of any kind to the fullest extent the law allows. We do not warrant that the site will be uninterrupted or error-free.
To the fullest extent the law allows, our total liability to you for any claim relating to the site or a product is limited to the amount you paid us for that product. We are not liable for indirect, incidental, or consequential damages.
You agree to cover losses we reasonably incur because you misused the products or the site or broke these Terms.
Our Privacy Policy explains how we handle your information and is part of these Terms.
We may update these Terms. We will post the new version with a new "last updated" date, and for material changes we will give reasonable notice. Continuing to use the site or products after a change means you accept the updated Terms.
These Terms are governed by the laws of the State of Oregon, without regard to its conflict-of-laws rules. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Washington County, Oregon, and you consent to their jurisdiction. If you are a consumer in the EEA or the UK, this does not remove the protections of the mandatory consumer laws of your home country.
